The Federal Police can continue investigations into the investigation into the alleged payment of bribes to President Michel Temer for issuing a decree related to the operation of the ports. The decision is made by Minister Luís Roberto Barroso, of the Federal Supreme Court.
According to the order, this is not an extension of the investigation. The PF had asked for 60 days to continue investigating facts linked to the decree, but the minister requested a statement from the Attorney General's Office.
A March report from the Federal B2B Lead Court of Auditors points out that, by providing for the possibility of changing the term of lease contracts in force, the decree opened a loophole so that the Executive could benefit, in the future, companies with longer contracts. old and that have not yet been regulated, as is the case of Rodrimar, which operates an area in the Port of Santos and is suspected of paying bribes to the president to be favored.

One of the provisions brought by Decree 9,048/2017 is to extend the term of concessions for port areas in contracts signed from 1993 onwards. The initial term foreseen for these contracts since the regulation envisaged in 1993 and maintained in 2013 was 25 years, extendable for up to 50 years. With the 2017 decree, the initial term was extended to 35 years, extendable up to 70.
With this change, the auditors point out, the government not only violates the legality of the bidding, which should have maintained its initial terms, but also opens a loophole for the government to enact new decrees that allow the extension of the terms of concessions for port areas in force, even those prior to 1993.
